These Creator Terms of Use govern access to and use of the Quro Collective platform by creators, hosts and journey leads.
1. Introduction
1.1 These Creator Terms apply when you access or use the Quro Collective platform as a content creator, host, journey lead, public figure, influencer or subject matter expert.
1.2 Your use of the Quro website is also subject to Quro’s Privacy Policy and General Site Terms.
1.3 By accessing or using the Platform in a creator or host capacity, including on first use of the Platform, you agree to be bound by these Creator Terms.
1.4 Access to creator or host features of the Platform is limited to creators approved by Quro.
1.5 These Creator Terms govern your access to and use of the Platform. They do not set out all commercial terms that may apply between you and Quro.
1.6 During the development period for a proposed Journey, you may be required to sign a memorandum of understanding or similar preliminary document with Quro.
1.7 Before a Journey is launched or customer bookings are accepted, you will be required to enter into a separate Creator Agreement or Journey-specific agreement with Quro. That agreement will deal with commercial and operational terms, including fees, revenue share, payment timing, deliverables, cancellation, exclusivity, non-solicitation, insurance, content obligations and Journey-specific requirements.
1.8 If there is any inconsistency between these Creator Terms and a Creator Agreement, Journey Schedule, Journey Brief or memorandum of understanding, the more specific document prevails to the extent of the inconsistency.
2. Definitions
In these Creator Terms:
ACL means the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
Booking means a confirmed purchase of a Journey by a Traveller from Quro.
Creator Agreement means any separate written agreement between you and Quro governing the commercial terms on which you develop, host, promote, lead or participate in Journeys, including any master creator agreement, Journey Schedule or similar agreement.
Creator Audience Data means your social media handles, follower and subscriber information, audience analytics, follower demographics, engagement statistics and channel analytics that you choose to provide to Quro through the Platform or otherwise.
Creator Content means content you submit to the Platform or provide to Quro in your capacity as a creator or Host, including your host profile, biographical information, photographs, videos, personal brand materials, names, handles, likeness materials and other content uploaded by you.
Creator Page means a self-serve webpage, profile page, landing page or similar page created for or by a creator through the Platform.
External Channels means third-party channels or external marketing channels, including press, media, public relations, paid media, third-party advertising placements and other non-Quro owned channels.
General Inputs means audience insights, content style preferences, general creative direction and other high-level information you contribute during Journey development.
Host, you or your means a content creator, influencer, public figure, subject matter expert or journey lead who accesses the Platform in a creator or host capacity or enters into a Creator Agreement with Quro.
Host Inputs means General Inputs and Impossible Moments.
Impossible Moments means personal relationships, connections, access or experiences that are specific to you and that are recorded or acknowledged by Quro in a Journey Brief as an Impossible Moment for a particular Journey.
Journey means a curated travel experience developed, listed, promoted or operated by Quro, whether alone or in collaboration with a Host.
Journey Brief means a document, brief, schedule or written record prepared or approved by Quro setting out operational, creative, itinerary, access, content, promotional or logistical details for a proposed or confirmed Journey.
Journey Content means content prepared by or for Quro in connection with a Journey, including itineraries, journey descriptions, experience frameworks, schedules, promotional copy, Journey pages, operational materials and Quro marketing materials.
Owned Channels means Quro’s own website, Platform, email database, social media accounts, customer communications, journey pages, promotional pages and other channels owned or controlled by Quro.
Platform means the Quro website at qurocollective.com and any associated applications, tools, portals, Creator Pages or services operated by or on behalf of Quro.
Privacy Policy means Quro’s Privacy Policy published at qurocollective.com/legal/privacy, as updated from time to time.
Quro, we, us or our means Quro Collective Pty Ltd ACN 692 832 885.
Quro-Requested Content means content, assets, videos, photographs, reels, testimonials, campaign materials or other creative materials specifically requested by Quro for Quro’s own use or as otherwise specified in a Creator Agreement, Journey Brief or written request.
Traveller means a person who books, enquires about or participates in a Journey.
Traveller Information means names, bios and any other Traveller information provided by Quro to you for the purpose of Journey development, hosting or delivery. Unless Quro otherwise agrees in writing, Traveller Information provided to you will be limited to Traveller names and bios.
3. How the Platform Works
3.1 Quro operates the Platform as a curated travel business. Quro is the operator of Journeys listed on the Platform and the merchant of record for Journey sales.
3.2 Travellers contract with Quro when booking a Journey.
3.3 As a Host, you may collaborate with Quro on Journey development, contribute your personal brand and audience context, promote Journeys and host or lead Journey experiences, subject to these Creator Terms and any applicable memorandum of understanding, Creator Agreement, Journey Brief or Journey Schedule.
3.4 Quro is responsible for the operational and logistical elements of Journey delivery, subject to the terms applicable to Travellers and any applicable Creator Agreement.
3.5 Your acts and omissions in connection with a Journey may expose Quro to claims by Travellers or third parties. Clause 14 addresses that allocation of risk.
3.6 These Creator Terms do not create an employment, partnership, joint venture or agency relationship between you and Quro, except to the extent expressly provided in a Creator Agreement.
3.7 You must not bind Quro, make commitments on Quro’s behalf, make representations regarding pricing, refunds, inclusions, availability or Journey terms, or incur liability on Quro’s behalf unless Quro has expressly authorised you to do so in writing.
4. Eligibility and Platform Access
4.1 To access the Platform as a Host, you must:
(a) be at least 18 years of age;
(b) have legal capacity to enter into a binding contract;
(c) if acting for a company or entity, have authority to bind that entity;
(d) not be prohibited from using the Platform under applicable law; and
(e) be approved by Quro to access creator or host features of the Platform.
4.2 By using the Platform as a Host, you represent and warrant that you meet these eligibility requirements.
4.3 Quro may approve, decline, suspend, restrict or remove access to creator or host features of the Platform at its discretion, subject to any applicable Creator Agreement.
5. Account Registration, Creator Pages and Security
5.1 You may be required to register an account to access creator or host features of the Platform.
5.2 You must provide accurate, current and complete information and keep your account information up to date.
5.3 You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
5.4 You must notify Quro promptly at hello@qurocollective.com if you become aware of unauthorised access to or use of your account.
5.5 You must not share your credentials or allow another person to access the Platform through your account without Quro’s prior written consent.
5.6 As part of onboarding, Quro may create, or allow you to create, a self-serve Creator Page. You may upload your own biography, images, profile materials and other approved materials to that Creator Page.
5.7 Unless otherwise agreed in writing:
(a) Creator Page may be used for development, onboarding and creator-led promotion;
(b) Quro will not actively promote a Creator Page through Quro’s broader promotional channels before a memorandum of understanding or other written approval is in place; and
(c) once a memorandum of understanding, Creator Agreement or other written approval is in place, Quro may use the Creator Page in accordance with these Creator Terms and the relevant agreement.
6. Host Obligations
6.1 Accuracy
You represent and warrant that all Creator Content, Creator Audience Data and Host Inputs you provide are accurate, complete and not misleading.
You must promptly notify Quro of any material change to information you have provided.
6.2 Cooperation
You must cooperate with Quro’s reasonable requirements for Journey development and delivery, including:
(a) participating in planning communications;
(b) providing audience and content context;
(c) reviewing Journey concepts where required;
(d) meeting agreed deadlines;
(e) complying with reasonable operational requirements; and
(f) using the Platform in accordance with these Creator Terms.
6.3 Hosting Standards
You must host and lead Journeys professionally, with reasonable care and skill, and in compliance with applicable laws.
You must not do anything that could reasonably be expected to:
(a) expose Quro to legal liability;
(b) endanger or harm a Traveller or third party;
(c) materially disrupt a Journey;
(d) damage Quro’s brand, reputation or commercial interests; or
(e) cause a breach of Quro’s obligations to Travellers, suppliers or regulators.
6.4 Prohibited Conduct
You must not:
(a) submit content that is false, misleading, defamatory, offensive or unlawful;
(b) infringe third-party intellectual property, privacy, publicity, confidentiality or other rights;
(c) publicly announce or represent a proposed or active Journey without Quro’s prior written consent;
(d) use the Platform for spam or unsolicited communications;
(e) harvest personal information from the Platform;
(f) interfere with or disrupt the Platform or its infrastructure;
(g) attempt unauthorised access to any part of the Platform or connected systems;
(h) use bots, scrapers or automated tools to extract Platform data;
(i) misrepresent your identity, credentials, experience or affiliation; or
(j) represent that a Journey is confirmed, available or approved unless Quro has expressly confirmed this in writing.
7. Traveller Information and Privacy
7.1 Quro collects, holds and controls Traveller Information generated through the Platform or in connection with a Journey.
7.2 Unless otherwise agreed in writing or required for Journey delivery, Quro will only provide you with limited Traveller Information, being Traveller names and bios.
7.3 Where Quro provides Traveller Information to you, you must:
(a) use it only for the purpose of planning, hosting or delivering the relevant Journey;
(b) keep it confidential and secure;
(c) not collect additional personal information from Travellers unless Quro has approved this in writing;
(d) not disclose it except as reasonably required for Journey delivery, with Quro’s approval, or as required by law;
(e) comply with applicable privacy laws and Quro’s Privacy Policy;
(f) promptly notify Quro of any actual or suspected data breach; and
(g) delete or return Traveller Information when it is no longer required for the authorised purpose, unless retention is required by law.
7.4 Any post-Journey communication with Travellers that relates to travel, Journey logistics, Quro services, refunds, complaints, future Quro Journeys or similar travel-related matters must occur through Quro, unless Quro gives written approval otherwise.
7.5 These Creator Terms do not restrict your ordinary engagement with your own pre-existing followers, subscribers or community members through your own channels, provided you do not use Traveller Information obtained through Quro to promote or arrange competing travel experiences or other travel-related commercial arrangements except as permitted by a Creator Agreement or with Quro’s written consent.
7.6 Any non-solicitation, exclusivity or restraint obligations relating to Travellers, Customers, Competing Journeys or travel-related direct deals are to be dealt with in the Creator Agreement.
8. Creator Audience Data
8.1 Creator Audience Data remains your property or under your control.
8.2 You may choose whether to provide Creator Audience Data to Quro.
8.3 If you upload or otherwise provide Creator Audience Data to Quro, Quro may use it to:
(a) assess creator fit and audience alignment;
(b) develop Journey concepts;
(c) plan marketing and promotional activity;
(d) assess potential demand for destinations, themes or experiences;
(e) prepare internal reports and forecasts; and
(f) improve the Platform and Quro’s services.
8.4 Quro may use aggregated or de-identified Creator Audience Data for internal planning, analytics and reporting.
8.5 Creator Audience Data does not include Traveller Information.
9. Intellectual Property
9.1 Your IP
Your pre-existing content, brand, trade marks, name, image, likeness, Creator Content and personal brand materials remain your property or under your control, except to the extent otherwise agreed in a Creator Agreement or in relation to Quro-Requested Content.
9.2 Licence to Quro for Creator Content
By submitting Creator Content to the Platform or providing it to Quro, you grant Quro a non-exclusive, worldwide, royalty-free licence to access, reproduce, store, display, adapt, distribute, publish and transmit that Creator Content for:
(a) operating the Platform;
(b) operating and displaying your Creator Page;
(c) developing, marketing and promoting Journeys for which you are contracted as Host, or which you have approved for development;
(d) communicating with Travellers and prospective Travellers about those Journeys;
(e) using Creator Content on Quro’s Owned Channels;
(f) archival, reporting and internal business purposes; and
(g) using materials already produced, published or committed before termination, subject to any Creator Agreement.
This licence is sublicensable to service providers, media partners, contractors and Platform providers only to the extent reasonably necessary for the permitted purposes.
9.3 Use on Owned Channels and External Channels
Quro may use Creator Content, approved profile materials, your name, handle, image, likeness and biography on Quro’s Owned Channels for the purposes described in clause 9.2.
Quro must obtain your written approval before using Creator Content, your name, handle, image, likeness or biography in External Channels, including press, media, public relations campaigns, paid media placements or external advertising campaigns, unless the relevant use is already approved under a Creator Agreement, Journey Brief or other written approval.
9.4 Name, Image and Likeness
You grant Quro permission to use your name, handle, image, likeness, voice, biography and approved profile materials for the purposes set out in these Creator Terms and any applicable Creator Agreement.
Any broader use outside the relevant Journey context or Quro’s Owned Channels must be approved in writing or addressed in the Creator Agreement.
9.5 Creator Approval Rights
You are responsible for Creator Content that you self-upload to your Creator Page.
Journey pages and promotional materials prepared by Quro that materially feature you, your name, image, likeness or biography should be submitted to you for approval before publication, unless otherwise agreed in a Creator Agreement or Journey Brief.
You must not unreasonably withhold or delay approval where the materials are consistent with information, content or approvals you have already provided.
9.6 Quro-Requested Content
Where Quro specifically requests that you create content for Quro, including videos, reels, photographs, testimonials, campaign assets or other deliverables, ownership and use of that content will be dealt with in the Creator Agreement, Journey Brief or written request.
Unless otherwise stated in the applicable Creator Agreement, Journey Brief or written request, Quro-Requested Content created specifically for Quro’s own use is owned by Quro upon creation or upon payment of any applicable fee, subject to your rights in your pre-existing materials, trade marks, name, image and likeness.
You must do all things reasonably required by Quro to confirm or give effect to Quro’s ownership or licence rights in Quro-Requested Content.
9.7 Continuing Use After Relationship Ends
Subject to any Creator Agreement, Quro may continue using Creator Content, Quro-Requested Content, Journey Content and approved materials after the creator relationship ends for:
(a) archived campaigns;
(b) already-launched Journeys;
(c) past Journey pages;
(d) materials already produced, published or committed;
(e) internal reporting and business records; and
(f) promotional materials already in circulation.
9.8 Host Inputs and Impossible Moments
You may contribute Host Inputs during Journey development.
General Inputs may be used by Quro to develop Journey concepts, itineraries, promotional materials and Journey Content. General Inputs do not give you ownership of Journey Content.
Where an Impossible Moment is recorded in a Journey Brief, Quro may only use that Impossible Moment in accordance with the Journey Brief and any applicable Creator Agreement.
Quro may use similar concepts, access, experiences or themes with another creator where Quro has obtained any approval required under the applicable Journey Brief or Creator Agreement.
9.9 Journey Content and Platform IP
Journey Content is owned by Quro or its licensors, whether or not it incorporates General Inputs or reflects your creative direction.
The Platform, including Quro’s website, software, designs, trade marks, operational methodologies, logistics frameworks, supplier networks, pricing models, Journey Content and Journey concepts, is owned by or licensed to Quro.
9.10 Moral Rights
To the extent permitted by law, you consent to Quro exercising the rights granted under these Creator Terms without attribution where attribution is impracticable, unreasonable or inconsistent with the relevant use.
9.11 Your Warranties
You represent and warrant that:
(a) you own or have all rights, licences and consents required to provide Creator Content, Creator Audience Data and Host Inputs;
(b) Quro’s authorised use of Creator Content will not infringe any third-party rights;
(c) Creator Content is not unlawful, defamatory or misleading; and
(d) you have obtained all required consents from identifiable persons appearing in Creator Content.
10. Content Moderation and Platform Rights
10.1 Quro may remove, edit or restrict access to Creator Content where Quro reasonably considers that the content:
(a) breaches these Creator Terms;
(b) is inaccurate, misleading, offensive or unlawful;
(c) infringes third-party rights;
(d) creates legal, safety or reputational risk; or
(e) may harm Travellers, users, third parties or the Platform.
10.2 Quro may suspend, restrict or terminate your Platform access immediately where Quro considers this necessary or appropriate due to:
(a) safety concerns;
(b) reputational concerns;
(c) legal or regulatory concerns;
(d) Traveller welfare concerns;
(e) suspected misuse of the Platform;
(f) suspected breach of these Creator Terms, a memorandum of understanding, Creator Agreement or Journey Brief; or
(g) any other matter that Quro considers may adversely affect Quro, Travellers, suppliers, creators, users or the Platform.
10.3 Quro may otherwise suspend, restrict or terminate your Platform access at its discretion, subject to any applicable Creator Agreement.
10.4 Termination or suspension of Platform access does not affect any confirmed Journey, accrued rights or obligations under a Creator Agreement except as provided in that Creator Agreement.
10.5 Quro may preserve and disclose Creator Content where reasonably necessary to comply with law, respond to claims, protect rights or safety, or operate the Platform.
11. Privacy
Quro collects and handles personal information in accordance with its Privacy Policy, the Privacy Act 1988 (Cth) and the Australian Privacy Principles, where applicable.
By using the Platform, you acknowledge Quro’s collection, use and disclosure of personal information as described in the Privacy Policy.
12. AI-Assisted Tools and Platform Data
12.1 Quro may use AI-assisted tools, including journey concept generation tools, for internal and creator-facing planning and development purposes.
12.2 AI-assisted tools may generate concepts using your name, handle, profile, Creator Content or other materials provided by you for the purpose of developing a Journey with you.
12.3 Unless you have consented, or unless otherwise permitted under a memorandum of understanding, Creator Agreement, Journey Brief or other written approval, Quro will not use your identity externally in AI-generated concepts or public-facing Journey concepts.
12.4 You acknowledge that:
(a) AI-generated journey concepts are illustrative only;
(b) generated concepts do not constitute confirmed itineraries, bookings or commercial arrangements;
(c) reference to your name, profile or handle in a development concept does not confirm that the Journey will proceed;
(d) Quro may use information submitted through the Platform to operate the Platform, develop journey concepts, assess host matches and communicate with prospective or contracted hosts; and
(e) AI-generated outputs may be inaccurate, incomplete or unsuitable and require human review before commercial use.
13. Disclaimer and Limitation of Liability
13.1 Disclaimer
The Platform is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, Quro does not warrant that the Platform will be uninterrupted, error-free, secure or free from harmful components.
This clause relates to the Platform as a tool and does not affect Quro’s obligations to Travellers or any non-excludable rights under the ACL.
13.2 Scope
This clause governs Quro’s liability to you as a Host in connection with your use of the Platform. It does not govern Quro’s liability to Travellers.
13.3 Excluded Loss
To the maximum extent permitted by law, Quro is not liable for indirect, incidental, special, consequential or punitive loss, including loss of profits, data, goodwill, followers, audience, business opportunity or opportunity.
13.4 Liability Cap
To the maximum extent permitted by law, Quro’s total aggregate liability to you in connection with these Creator Terms or the Platform is limited to the greater of:
(a) AUD $100; and
(b) amounts paid by Quro to you under the Creator Agreement in the three months immediately preceding the event giving rise to the claim.
13.5 ACL Carve-Out
Nothing in these Creator Terms excludes, restricts or modifies any right, remedy, guarantee, warranty or other term implied or imposed by the ACL or any other law that cannot lawfully be excluded, restricted or modified.
14. Indemnity
You indemnify Quro and its directors, officers, employees, contractors and agents against claims, losses, liabilities, costs and expenses, including reasonable legal costs, arising directly from:
(a) your breach of these Creator Terms;
(b) your breach of a memorandum of understanding, Creator Agreement, Journey Brief or Journey Schedule;
(c) Creator Content, Creator Audience Data or Host Inputs that are inaccurate, misleading, unlawful or infringe third-party rights;
(d) your misuse of the Platform;
(e) your breach of applicable law;
(f) your negligence, reckless conduct or wilful misconduct;
(g) your unauthorised use or disclosure of Traveller Information; or
(h) injury, loss or damage suffered by a Traveller or third party to the extent caused or contributed to by your acts or omissions.
The indemnity is reduced to the extent the relevant loss is caused or contributed to by Quro.
Quro will notify you of any claim for which indemnity is sought and will give you a reasonable opportunity to participate in the defence, at your cost. Quro may take reasonable steps to protect its interests where delay may cause material harm.
15. Insurance
Where you attend a Journey, you must hold and maintain comprehensive travel insurance appropriate for the destination and Journey activities.
Your travel insurance must cover, at a minimum, overseas medical expenses, emergency evacuation and repatriation, cancellation, personal liability and personal effects.
You must provide evidence of travel insurance on request.
Any additional insurance requirements will be dealt with in the applicable Creator Agreement, Journey Brief or Journey Schedule.
16. Termination
16.1 Termination by You
You may cease using the Platform as a Host at any time and request account deletion by contacting hello@qurocollective.com.
Termination of Platform access does not affect rights or obligations under a memorandum of understanding, Creator Agreement, Journey Brief or Journey Schedule.
16.2 Termination or Suspension by Quro
Quro may suspend, restrict or terminate your Platform access:
(a) where you breach these Creator Terms, a memorandum of understanding, Creator Agreement, Journey Brief or Journey Schedule;
(b) where your conduct harms or may harm Travellers, users, third parties, Quro, suppliers or the Platform;
(c) where your conduct creates legal, safety, operational, traveller welfare or reputational risk;
(d) where Quro considers suspension, restriction or termination necessary for business, operational, compliance or risk-management reasons; or
(e) at Quro’s discretion.
16.3 Effect on Confirmed Journeys
Termination, suspension or restriction of Platform access does not itself determine whether a confirmed Journey proceeds, is cancelled or is transferred. Those matters are governed by the applicable Creator Agreement, Journey Brief or Journey Schedule.
16.4 Effect of Termination
On termination:
(a) you must cease using the Platform in a Host capacity;
(b) licences granted to you cease immediately;
(c) Quro may continue using Creator Content, Quro-Requested Content, Journey Content and other materials as permitted by these Creator Terms and any applicable Creator Agreement; and
(d) clauses intended to survive termination continue in force, including clauses 7, 8, 9, 13, 14, 16, 19 and 20.
17. Copyright Complaints
If you believe content on the Platform infringes copyright, contact Quro at hello@qurocollective.com with:
(a) details of the work claimed to be infringed;
(b) the location of the allegedly infringing content;
(c) your contact details; and
(d) a statement that you have a good-faith belief the use is not authorised.
Quro will respond to valid complaints in accordance with applicable law.
18. Changes to These Terms
Quro may update these Creator Terms by publishing updated terms on the Platform.
For material changes, Quro will provide at least 14 days’ notice by email or in-platform notification where reasonably practicable.
Your continued use of the Platform after the effective date of an update constitutes acceptance of the updated terms.
19. Governing Law and Jurisdiction
These Creator Terms are governed by the laws of Victoria, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
20. General
20.1 Relationship to Other Documents
These Creator Terms govern Platform use. A memorandum of understanding, Creator Agreement, Journey Brief or Journey Schedule governs specific development, commercial, Journey-specific and operational arrangements.
20.2 Entire Platform Agreement
These Creator Terms constitute the entire agreement between you and Quro in relation to Platform use in a Host capacity, subject to any more specific agreement or document referred to in clause 20.1.
20.3 Severability
If any provision is invalid or unenforceable, it will be severed to the extent necessary and the remaining provisions continue in force.
20.4 No Waiver
Failure to enforce a provision is not a waiver of that provision.
20.5 Assignment
Quro may assign its rights and obligations under these Creator Terms where this does not materially prejudice your rights.
You may not assign your rights or obligations without Quro’s prior written consent.
20.6 Notices
Notices to you may be sent to your registered email address or provided through the Platform.
