Journey Builder Tool Terms

These Journey Builder Tool Terms govern your use of Quro Collective’s journey concept builder tool.

1. Introduction

1.1 The Journey Builder Tool allows users to explore hypothetical journey ideas by nominating a creator, destination and other travel preferences.

1.2 The Tool is available to the public. You may be required to provide your name and email address before receiving a journey concept.

1.3 By accessing or using the Tool, submitting information through the Tool, or receiving a Tool Output, you agree to these Journey Tool Terms.

1.4 Your use of the Quro website is also subject to Quro’s General Site Terms and Privacy Policy.

1.5 If you make a booking with Quro, that booking will be governed by Quro’s Booking Terms and Conditions.

1.6 If there is any inconsistency between these Journey Tool Terms and the General Site Terms in relation to the Tool, these Journey Tool Terms prevail to the extent of the inconsistency.

2. Definitions

In these Journey Tool Terms:

ACL means the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth).

Booking Terms and Conditions means Quro’s booking terms and conditions, as updated from time to time.

Creator means a content creator, influencer, public figure, host, journey lead or other person who may be nominated, referenced or displayed in connection with the Tool.

General Site Terms means Quro’s general site terms available at qurocollective.com/legal/site-terms, as updated from time to time.

Journey means a creator-hosted travel experience listed, promoted or operated by Quro.

Journey Tool Terms means these Journey Builder Tool Terms.

Privacy Policy means Quro’s privacy policy available at qurocollective.com/legal/privacy, as updated from time to time.

Quro, we, us or our means Quro Collective Pty Ltd ACN 692 832 885.

Tool means Quro’s journey builder tool, journey concept generator or any similar tool made available through the Quro website or platform.

Tool Output means any journey concept, itinerary, destination suggestion, accommodation suggestion, price indication, activity suggestion, “impossible moment”, creator reference or other output generated by or displayed through the Tool.

Website means qurocollective.com.

you or your means any person who accesses or uses the Tool.

3. Purpose of the Tool

3.1 The Tool is designed to generate hypothetical and illustrative journey concepts based on information submitted by users.

3.2 The Tool is provided for discovery, inspiration, product planning and exploratory purposes only.

3.3 Tool Outputs are not confirmed journeys, bookings, reservations, commercial offers, quotes, representations or binding commitments by Quro.

3.4 All actual Journey details, inclusions, pricing, availability, suppliers, hosts and departure dates are determined by Quro only if and when a Journey is formally developed and offered.

4. AI-Assisted and Template-Based Outputs

4.1 The Tool may use AI-assisted technology, automated systems, pre-approved Quro templates, pre-approved Quro data, user inputs and other data sources to generate Tool Outputs.

4.2 Tool Outputs may be generated instantly and may not be manually reviewed by Quro before they are shown or sent to you.

4.3 Tool Outputs may include hypothetical:

(a) destinations;

(b) itineraries;

(d) accommodation suggestions;

(e) activity suggestions;

(f) travel styles;

(g) pricing indications;

(h) inclusions and exclusions;

(i) creator names, handles, images, profiles or social media information; and

(j) “impossible moments” or special access concepts.

4.4 Tool Outputs may be inaccurate, incomplete, outdated, unsuitable, unavailable, speculative or inconsistent with actual supplier availability, destination conditions, creator availability, pricing, safety requirements or operational requirements.

4.5 Quro does not warrant that any Tool Output is accurate, complete, current, suitable for your purpose, commercially viable, available, safe, lawful in all destinations, or capable of being offered as a Journey.

4.6 Tool Outputs require review, verification and approval by Quro before they may be developed, promoted or offered as a commercial Journey.

5. No Booking, Offer or Guarantee

5.1 Nothing generated by, displayed through or communicated in connection with the Tool constitutes:

(a) a confirmed booking;

(b) a reservation;

(d) a binding agreement;

(e) a quote;

(f) a guarantee of availability;

(g) a guarantee of pricing;

(h) a guarantee that any itinerary, activity, supplier, accommodation, destination or experience will be available;

(i) a guarantee that any nominated Creator will participate in, endorse, promote or host a Journey; or

(j) a recommendation or endorsement of any supplier, destination, activity, accommodation provider or Creator.

5.2 A binding booking with Quro is formed only when Quro issues a written booking confirmation in accordance with the Booking Terms and Conditions.

6. Creator Nominations and Affiliations

6.1 The Tool may allow you to nominate any Creator, including Creators who have no relationship or commercial arrangement with Quro.

6.2 The Tool may display or refer to Creator names, handles, images, profiles, social media information, audience interests or other publicly available or user-submitted Creator information.

6.3 Unless Quro expressly states otherwise in a public announcement or written confirmation, a Creator whose name, handle, image, profile, likeness or social media information appears in or is nominated through the Tool:

(a) is not affiliated with Quro;

(b) has not endorsed Quro;

(d) has not agreed to participate in any Journey;

(e) has not agreed to host or promote any Journey;

(f) has not entered into a commercial arrangement with Quro;

(g) may not know about the Tool Output; and

(h) may never host, promote or participate in any Journey generated by the Tool.

6.4 You must not represent to any third party that a Creator is involved with Quro, endorses Quro, has approved a Tool Output, or will host or promote a Journey unless that involvement has been publicly confirmed by Quro.

6.5 Quro will seek appropriate consent before entering into any commercial arrangement with a Creator.

7. Information You Submit

7.1 To use the Tool, you may be asked to submit information, including:

(a) your name;

(b) email address;

(d) destination preferences; and

(e) any other information you choose to provide.

7.2 You must ensure that information you submit through the Tool is accurate, lawful and not misleading.

7.3 You must not submit information that infringes another person’s rights, contains unlawful material, or includes sensitive information about another person without their consent.

8. Use of Submitted Information

8.1 Quro may use information submitted through the Tool to:

(a) generate illustrative journey concepts;

(b) assess interest in destinations, Creators, travel styles and experiences;

(d) assess potential Creator partnerships;

(e) communicate with you about relevant journeys, concepts, product updates and offers;

(f) conduct internal business analysis and reporting;

(g) improve the Tool, Website and Quro’s services; and

(h) comply with legal, operational and administrative requirements.

8.2 Quro may use aggregated or de-identified information for internal planning, analytics, reporting and business development.

9. Privacy

9.1 Quro collects, uses, stores and discloses personal information in accordance with its Privacy Policy, the Privacy Act 1988 (Cth) and the Australian Privacy Principles, where applicable.

9.2 By using the Tool, you acknowledge that Quro may collect and use your personal information as described in these Journey Tool Terms and the Privacy Policy.

9.3 Quro will not sell your personal information to third parties.

9.4 The Privacy Policy is available at qurocollective.com/legal/privacy and should be reviewed together with these Journey Tool Terms.

10. Marketing Communications

10.1 Where you opt in or where otherwise permitted by law, Quro may send you marketing communications about journeys, product updates, Creator partnerships, offers and related Quro services.

10.2 You may be asked to opt in to receive promotional emails or other marketing communications when submitting your details through the Tool.

10.3 You may unsubscribe from marketing communications at any time by using the unsubscribe link in an email or by contacting Quro at hello@qurocollective.com.

10.4 Unsubscribing from marketing communications will not prevent Quro from sending administrative or transactional communications relating to enquiries or services you have requested.

11. Public Sharing and Use of Tool Outputs

11.1 Tool Outputs are provided to you for personal, private and non-commercial exploration only.

11.2 You must not publish, post, upload, distribute, share, screenshot, reproduce or otherwise make Tool Outputs publicly available without Quro’s prior written consent.

11.3 You must not use Tool Outputs for any commercial purpose without Quro’s prior written consent.

11.4 You must not represent or imply that any Tool Output is a confirmed Quro Journey, a commercial offer, a quote, an approved itinerary, an endorsed concept, or a Journey that will proceed.

11.5 You must not use a Tool Output in a way that suggests any Creator, supplier, accommodation provider, activity provider or destination partner is affiliated with, endorses or participating in Quro unless Quro has publicly confirmed that relationship.

12. User Conduct

You must not use the Tool:

(a) for any unlawful, fraudulent or misleading purpose;

(b) to generate, publish or distribute misleading claims about Quro, Creators, suppliers, destinations or journeys;

(d) to imply that any Creator is affiliated with or endorses Quro unless publicly confirmed by Quro;

(e) to infringe any intellectual property, privacy, publicity, confidentiality or other rights;

(f) to upload, transmit or distribute malicious code, viruses or harmful material;

(g) to scrape, harvest, mine, extract or copy data using bots, crawlers, scrapers or automated tools without Quro’s prior written consent;

(h) to interfere with, disrupt or damage the Tool, Website or connected systems;

(i) to attempt unauthorised access to any account, system, network or data; or

(j) to publish or commercially exploit Tool Outputs without Quro’s prior written consent.

13. Intellectual Property

13.1 The Tool, Website, software, design, layout, journey frameworks, prompts, templates, Quro data, Quro content, trade marks, branding, business methods and related materials are owned by or licensed to Quro.

13.2 Tool Outputs are generated for personal, private and non-commercial exploration only.

13.3 You must not reproduce, publish, adapt, commercialise, sell, license, scrape, extract, copy, distribute or represent Tool Outputs as confirmed Quro products without Quro’s prior written consent.

13.4 If you submit suggestions, ideas, feedback or preferences through the Tool, Quro may use them for product development, business planning, marketing, service improvement and other business purposes without obligation to compensate you, subject to applicable privacy laws.

14. Availability and Changes to the Tool

14.1 Quro may modify, suspend, restrict or discontinue the Tool at any time for operational, technical, legal, security, compliance or business reasons.

14.2 Quro does not guarantee that the Tool will be continuously available, uninterrupted, secure, error-free or free from viruses or harmful components.

14.3 Quro may update, change or remove Tool Outputs at any time.

15. Third-Party Content and Links

15.1 The Tool may refer to or link to third-party platforms, destinations, suppliers, accommodation providers, social media platforms or other external content.

15.2 Quro does not control third-party platforms and is not responsible for their content, availability, security, privacy practices, terms of use or performance.

15.3 Your use of third-party platforms is subject to the terms and policies of those third parties.

16. Disclaimer

16.1 The Tool and Tool Outputs are provided for general information, discovery and exploratory purposes only.

16.2 To the maximum extent permitted by law, Quro does not warrant or represent that:

(a) the Tool will be continuously available, uninterrupted, secure or error-free;

(b) Tool Outputs will be accurate, complete, current, suitable, available or commercially viable;

(d) any Creator, supplier, property, destination or activity referenced in a Tool Output will be available, willing to participate or affiliated with Quro;

(e) any pricing indication will reflect actual Journey pricing;

(f) any accommodation, activity, destination or experience suggested by the Tool will be available, suitable or safe; or

(g) the Tool will meet your expectations or requirements.

16.3 Nothing in these Journey Tool Terms excludes, restricts or modifies any right, remedy or guarantee under the ACL or any other law that cannot be excluded, restricted or modified.

17. Limitation of Liability

17.1 To the maximum extent permitted by law, Quro is not liable for loss or damage arising from:

(a) reliance on Tool Outputs;

(b) inaccuracies, omissions or errors in AI-assisted content;

(d) your use, publication, sharing or communication of Tool Outputs;

(e) representations made by you or third parties about hypothetical Tool Outputs;

(f) third-party platforms, links, suppliers or content;

(g) any Creator not being affiliated with, available for, or willing to participate in a Journey; or

(h) any decision by Quro not to develop, offer or operate a Journey concept.

17.2 To the maximum extent permitted by law, Quro’s liability arising from your use of the Tool is limited to:

(a) resupplying the relevant information or service;

(b) paying the cost of resupplying the relevant information or service; or

17.3 To the maximum extent permitted by law, Quro is not liable for indirect, incidental, special, consequential or economic loss, including loss of opportunity, loss of profit, loss of data or business interruption.

17.4 Nothing in these Journey Tool Terms excludes, restricts or modifies any right, remedy or guarantee under the ACL or any other law that cannot be excluded, restricted or modified.

18. Changes to These Journey Tool Terms

18.1 Quro may update these Journey Tool Terms from time to time by publishing updated terms on the Website.

18.2 The updated terms will apply from the effective date stated in the updated version or, if no effective date is stated, from the date they are published.

18.3 Your continued use of the Tool after updated terms are published constitutes acceptance of the updated terms.

19. Governing Law and Jurisdiction

19.1 These Journey Tool Terms are governed by the laws of Victoria, Australia.

19.2 The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

19.3 Nothing in this clause prevents you from lodging a complaint with a relevant consumer protection authority or regulator.

20. General

20.1 Severability

If any provision of these Journey Tool Terms is invalid or unenforceable, it will be severed to the extent necessary and the remaining provisions will continue in force.

20.2 No Waiver

A failure or delay by Quro in exercising a right does not constitute a waiver of that right.

20.3 Assignment

Quro may assign or transfer its rights and obligations under these Journey Tool Terms where this does not materially prejudice your rights.

You must not assign your rights or obligations under these Journey Tool Terms without Quro’s prior written consent.

20.4 Entire Agreement

These Journey Tool Terms, together with the General Site Terms and any other terms expressly incorporated by reference, constitute the entire agreement between you and Quro in relation to your use of the Tool.
